MDTVIP - Terms of Service

Terms of Service

Upon the order, the following Terms of Service have been agreed to between Maximus Management Group, Inc. the sole provider of MDTVIP.com, and you, the Customer.

1. The Service

Through MDTVIP.com, Maximus Management Group, Inc. provides an exclusive subscription based internet educational service and online marketing resource for active members. Customers will be privy to view exclusive information and share experiences to be viewed by other active members. Members are also permitted and encouraged to submit their company’s contact information to be viewed and shared with other members of the MDTVIP.com network. Such contact information is to be used for professional business networking and NOT to be abused or mistreated.

2. The Customer

This online service is provided to registered users, hereinafter referred to as "the Customer." On registration, the Customer agrees to:

(a) fill out the registration form with current, complete, and accurate data about the Customer
(b) maintain and promptly update this data as current, complete and accurate
(c) agree to the Terms of Service stated herein

The Customer agrees to receive educational suggestions and strategies and commercial information about products and services presented by Maximus Management Group, Inc., and associated strategic partners. The Customer understands and agrees that Maximus Management Group, Inc. may present advertisements within the MDTVIP.com website.

3. Membership Account

On registration of a Membership Account, the Customer agrees to pay recurring monthly fees for the Service, per the subscription plan in the amount of $9.95 per month. This amount is subject to change at the discretion of Maximus Management Group, Inc. In the event of a change in price structure, the Customer will be informed via email of such changes.

4. Customer Obligations

As a subscribed member of MDTVIP.com, you as the Customer will receive exposure and contact information to a host of different businesses and persons. Such information is considered to be exclusive and privy. Maximus Management Group, Inc. does not, in any way, guarantee the level of quality or performance of the products or services of any business featured on MDTVIP.com. Further, without any limitations, the Customer agrees not to send unsolicited messages ("spam") or undertake any unlawful practices in regards to these advertised names, numbers, and contact information.

The Customer is obliged to provide accurate and true registrant contact details, and maintain such details up to date. If the Customer provides any information that is untrue, inaccurate, outdated or incomplete, or if Maximus Management Group, Inc has reasonable grounds to suspect that such information is untrue, inaccurate, outdated or incomplete, Maximus Management Group, Inc. has the right to suspend or terminate the account and refuse any and all current or future use of the Service.

Maximus Management Group, Inc. reserves the right to refuse access to the website, terminate accounts, remove or edit content, alter price structures, or cancel orders at its sole discretion. Maximus Management Group, Inc. reserves the right to refuse any and all current or future use of the Service to the Customer, who intentionally or maliciously evades the obligations stated in these Terms of Service or arising from custom and other best practices of conduct on the Internet.

If Maximus Management Group, Inc. finds the Customer to be spamming or using the Service for any abusive or illegal practices, a warning will be issued. If Maximus Management Group, Inc. has any reason to believe that the Customer, despite the explicit warning, appears to perform or is performing such practices, then Maximus Management Group, Inc. may take appropriate actions immediately, including disabling customer's account and terminating the Service, and/or reporting the Customer and the incident to proper authorities.

5. Payments

The Customer is obliged to pay and comply with all subscription fees for the Service, according to the chosen payment structure. A subscription plan is valid for a certain period of time in which Maximus Management Group, Inc. provides the MDTVIP.com services to the Customer. The Customer agrees to pay recurring fees for the subscription, per the subscription plan. The recurring fee is based on the price list which is presented on the MDTVIP.com website.

The recurring monthly payments will be issued approximately thirty (30) days after the anniversary monthly calandar date of Customer signup ("recurring date"). If the recurring payment is unsuccessfully processed on that date, Maximus Management Group, Inc. will retry to complete the payment in the following days. Upon payment, the Customer will receive an email containing a payment confirmation receipt and an invoice.

Maximus Management Group, Inc. reserves at sole discretion the right to change the fees for the Service subscription.

The Customer may withdraw from subscription without any fee and/or obligation. In order to exercise the right to withdrawal, the Customer is required to send an email message about the cancellation to the Maximus Management Group, Inc. Billing Department at: support@mdtvip.com.

In accordance with the reocurring billing subscription process, the Customer will be charged one final monthly payment if the notice of intention to withdraw is received within twenty eight (28) days of the monthly anniversary date of the Customer’s signup date.

6. Technical Requirements

Maximus Management Group, Inc. assures that the Service will operate properly on Windows 95/98/NT/2000/Me/XP platform, with Internet Explorer 6.0, or higher. The Customer realizes that the Service is provided on the "as is" basis.

7. Customer Support Service

Maximus Management Group, Inc. provides customer email support. The Customer may address all questions, doubts, and report errors via email to MDTVIP.com Customer Support department at: support@mdtvip.com.

Maximus Management Group, Inc. does not investigate or take any action based on "anonymous" support requests. Maximus Management Group, Inc. assures that an email response shall take place within up to two (2) business days after receiving a request from the Customer.

8. Privacy Policy

Maximus Management Group, Inc. constitutes the Privacy Policy as an inherent part of these Terms of Service.

Maximus Management Group, Inc. will never use the information about the Customer or their customers that is collected within the Service to send any unsolicited messages or information nor share it with or sell to anyone else for such use.

Members wishing to list their business and contact information on our Business Network do so voluntarily and at their own risk. Maximus Management Group, Inc. and all associated strategic partners, under no circumstances, offer any protection, warranties, or insulation from fraudulant or adverse effects from SPAM, solicitation or the like from other members or third parties. The MDTVIP.com Business Network is designed to present networking opportunities for active subscribers.

9. Anti-Spam Policy

Maximus Management Group, Inc. constitutes the Maximus Management Group, Inc. Anti-Spam Policy as an inherent part of these Terms of Service.

The Customer or any third party working on behalf of the Customer shall not use the Service and/or the name of the service provider, or any of the trademarks of the service provider, to SPAM. SPAMing is a policy that will not be tolerated. Customers discovered to engage in such conduct risk having their subscription terminated.

10. Complaint Procedure

The Customer accepts unconditionally that the Service is distributed on the "as is" basis without warranties of any kind, either expressed or implied. The Customer is requested to submit possible complaints to the Customer Support Department at: support@mdtvip.com.

When submitting a complaint, the Customer should provide as a minimum their full name, email, subject of complaint, and message. Maximus Management Group, Inc. does not investigate or take any action based on "anonymous" complaints. The Customer Support Department will investigate the problem as soon as possible and advise the Customer how the issue will be processed.

The Customer has the right to be advised about the status of processing their issue. If the problem with the Service occurred, Maximus Management Group, Inc. assures to undertake all measures to solve it as soon as possible.

11. Copyrights and Trademarks

All content included on the MDTVIP.com website, such as text, graphics, logos, button icons, images, audio clips and software, is the property of Maximus Management Group, Inc. or its content suppliers and protected by U.S. and international copyright laws. No part of this website may be reproduced or transmitted in any form or by any means without express written consent from the authors.

Trademarks of Maximus Management Group, Inc. may not be used in conjunction with other companies' products or services without prior written consent nor in any manner that may cause confusion among customers and potential customers, or in any manner that discredits Maximus Management Group. Inc, its products or services.

12. Privacy

The Customer recognizes that they are the controller of all personal data which is provided by them to Maximus Managemen Group, Inc. Maximus Management Group, Inc. is responsible for ensuring sufficient security measures for processing personal data given to Maximus Management Group, Inc. by the Customer.

Maximus Management Group, Inc. will keep the personal data given by the Customer for as long as it is required in order to perform its obligations under this Agreement. Maximus Management Group, Inc. will not provide any personal Customer data to third parties.

The Customer realizes that when offering their company name and contact information to be listed in the Business Network they do so volutary. Customer’s subscription to MDTVIP.com is not dependent upon listing their company contact information in the Business Network.

The Customer realizes that posting their company name and contact information encourages and invites the opportunity for a degree of solicitation from unknown persons or parties. The Customer agrees that Maximus Management Group, Inc. does not in any way guarantee, represent, encourage, or discourage any such solicitations. Further, the Customer acknowledges and agrees to hold Maximus Management Group, Inc. free of any fault or liablity of any undesired solicitations or guarantees by persons or parties viewing the Business Network.

13. Termination of Service

The Customer may terminate the Service at anytime through written notice either via email or mail. If the Customer wants to terminate the service via email, they are required to send a cancellation request to the Maximus Management Group, Inc. Billing Department at: support@mdtvip.com, and provide at least the account name and the email address, no later than two business days prior to the recurring date. If the Customer prefers to terminate the service via traditional mail a letter can be forwarded to Maximus Management Group, Inc., P.O. Box 10, Bible School Park, New York 13737.

Maximus Management Group, Inc. reserves at sole discretion the right to terminate the account service in the event of not receiving a due payment or a recurring payment. Maximus Management Group, Inc. reserves at sole discretion the right to instantly terminate the Service in the event (i) the Customer is found to be using Maximus Management Group, Inc. services for SPAM activities and other abusive or illegal practices as previously mentioned. Maximus Management Group, Inc. reserves at sole discretion the right to terminate the Service in the event of receiving an independent verification that the Customer provided grossly inaccurate, unreliable or false registrant contact details, or failed to keep such contact details up to date.

In the aforementioned situations, the Service will be terminated with an immediate effect. Any down payment made by the Customer will not be re-calculated. The Customer shall not be eligible for reimbursement of the sum paid or any part of such sum. Maximus Management Group, Inc. will not perform any re-calculation of the down payment amounts.

14. Disclaimer of Warranties, Limitation of Liabilities

MAXIMUS MANAGEMENT GROUP, INC. DOES NOT WARRANT FOR THE WEBSITE AND THE SERVICE IT IS PROVIDING. MAXIMUS MANAGEMENT GROUP, INC. DISCLAIMS ANY WARRANTY OF TITLE, MERCHANTABILITY, NON-INFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE. THE SERVICE AND THE WEBSITE ARE DISTRIBUTED ON THE "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED.

Maximus Management Group, Inc. is not responsible for any delay or failure in performance due to occurrences that are beyond Maximus Management Group’s reasonable control. Maximus Management Group, Inc. is not responsible for short, temporary and accidental suspension of the Service, as the result of the circumstances which Maximus Management Group, Inc. could not foresee or suspect.

The use of the Service is at Customer's sole risk. Maximus Management Group, Inc. is in no way responsible for the conduct of its Customers. Maximus Management Group, Inc. is not responsible for any indirect, incidental, special, punitive or consequential damages that result from Customer's or their users' use of the Service without limitation.

Maximus Management Group, Inc. shall have no liability for any damages inflicted by the Customer or any third party, as the result of the use or misuse of the Service.

15. Final Provisions

The illegality or unenforceability of any provision of this Terms of Service shall not affect the validity and enforceability of any legal and enforceable provisions hereof.

It is also understood and agreed by the parties that if any provision of this Agreement is prohibited or is unenforceable under the law of any government having jurisdiction, (i) such an invalid or unenforceable provision will be modified to the extent necessary to render it valid and enforceable without altering its intent, or (ii) if such modification is not possible, these Terms of Service will be construed as if such invalid or unenforceable provision had never been contained in these Terms of Service.

Maximus Management Group, Inc. reserves the right to modify, add or delete any documents, information, graphics or other content appearing on or in connection with the MDTVIP.com website, including these Terms of Service, at any time, without prior notice. The Customer agrees that their continued use of the Service after such update will constitute their acceptance of and agreement to be bound by the updated Terms of Service. This Service shall be interpreted and construed according to, and governed by, the laws of the United States of America.

The laws of the Broome Coutny Court in the State of New York of the United States shall be the governing jurisdiction.
